Mally Beauty Artist Terms and Conditions
Mallygirl, LLC (alternatively, “Mally” “We”, “Us” or “Our”), maintains this website located at www.mallybeauty.com and its associated and/or successor websites, web pages, content and other materials (collectively the “Site”) to provide to its customers (“You” or “Your”) information about Mally, its products, services (“Products”) and the beauty industry. You have expressed interest to become an Artist under the Mally Beauty’s special purchase program for makeup artists (the “Artist Program”). You acknowledge, agree to and certify that You (i) have read and understood the Mally Beauty Website Terms of Use required for use of the Site, (ii) agree to be fully bound by such Terms of Use (the terms and conditions of which are incorporated by reference as if fully set forth herein) and (iii) agree to these Artist Terms and Conditions. Any capitalized terms not defined herein shall have the same meaning as those capitalized terms in the Mally Beauty Website Terms of Use.
1. Qualification
To qualify as an artist under the Artist Program (an “Artist”), You must complete the Artist Sign-up Form which may be downloaded from the Site. The completed form must be submitted together with evidence that You are a working makeup artist. Examples of such evidence include, but are not limited to, copies of invoices, business letterhead, promotional materials or tear sheets. If You operate as an Artist through a business, You must include the Tax Identification Number of the business. Once you have been qualified as an Artist, You will receive a code for the Site which will provide You with access to Our Artist communication board and to special pricing applicable to Artists. We reserve the right to periodically request updated evidence from You to confirm that You continue to be a working Artist. The same type of evidence that initially qualified You as an Artist in the Artist Program will suffice to confirm Your continuing qualification.
2. Discount
As a qualified Artist, you will receive a 30% discount on Mally Products that You purchase through the Site. If You are both an Artist and a Team Leader under the Mally Beauty referral program, You may receive only Your Artist Discount on Product purchases and You will not qualify for the Team Leader rebate of 10% on Your Product purchases (See “Team Leader Terms and Conditions” for more details).
For the purpose of calculating your discounts, they shall only apply to Product purchased directly from Our Site. Any Products purchased from any other source, including but not limited to, QVC (including their exclusive products) or other retailers, shall not be eligible for any discounts. We do not have access to the information on such sales to be in a position to calculate or apply discounts purchased from those other sources.
3. Reselling Strictly Prohibited.
The primary purpose of the Program is to encourage Artists to purchase Products from Our Site for their own use. The resale of any of Our Products purchased from Our site is strictly prohibited. In event that You violate, directly or indirectly, this reselling prohibition, You will be immediately terminated from the Program and in addition, You will be barred from making any further future purchases of Product at Our Site.
