2. How to Enter
In order to enter, each participating person must fill out and submit the entry form (the “Entry Form”), available at www.mallybeauty.com/fall-fashion-week (the “Website”) between February 11, 2013 and February 18, 2013 (the “Submission Period”).
Mally Beauty must receive all Entry Forms through the Website during Submission Period for a participant to be eligible to win. By completing and submitting an Entry Form, each participant receives one (1) entry into the Sweepstakes. Participants are limited to one (1) entry during the Submission Period.
3. Selection of Winners
Mally Beauty will randomly select three (3) Winners from among all Entry Forms submitted during the Submission Period. All three (3) Winners will receive a piece from the Tracy Reese Plenty collection and Mally Beauty products to complete the look.
All Winners will be notified by phone, email, or mail based upon the information provided by each participant on the Entry Form. The Winners will be notified on February 25, 2013. All qualified entries will be considered. Odds of winning a prize depend on the number of eligible entries received. If a potential Winner does not respond within five (5) days from the date Mally Beauty first tries to notify him/her, and/or the prize or prize notification is returned as undeliverable, such potential Winner forfeits all rights to win the promotion or receive the prize, and an alternate Winner will be selected.
4. Prizes
Each Winner will receive one (1) piece from the Tracy Reese Plenty collection. Winners will also receive Mally Beauty products to complete the runway look with a retail value of Four Hundred Dollars ($400.00).
These prizes will be mailed within six (6) to eight (8) weeks after the Winner’s mailing address is verified.
Income and other taxes (if any) are the responsibility of the Winner. Prizes are non-transferable. Mally Beauty reserves the right to substitute any prize for a prize of equal or greater value. The failure to accept any prize within five (5) days after notification shall result in a forfeiture of any prize awarded hereunder.
5. Eligibility
The Sweepstakes is open to legal residents of the U.S. residing in the 48 contiguous states, Alaska, Hawaii, and the District of Columbia, 18 years or older. Individuals who are or were employees of Mally Beauty, its affiliates, manufacturers, sales representatives, subsidiaries or parent companies, advertising/sales promotion agencies, judging organization since January 1, 2011, and the immediate families of each are not eligible. Void where prohibited. Entry materials become the property of Mally Beauty and will not be acknowledged or returned. Mally Beauty is not responsible for lost, late, damaged, misdirected, or illegible Entry Forms or unsuccessful attempts to notify the Winner.
6. Conditions
All federal, state, and local laws and regulations apply. Void where prohibited. Mally Beauty is not responsible for any additional expenses incurred by participants in connection with participating in the Sweepstakes or the claim or use of any prize awarded in the Sweepstakes. By submitting an Entry Form, each participant agrees to be bound by these Sweepstakes Rules and Regulations. Any decisions related to the Sweepstakes, Sweepstakes Rules and Regulations, operation of the Sweepstakes, or qualifications and eligibility of any participant shall be made by Mally Beauty, in its sole discretion, and are final. Each participant agrees to release and hold Mally Beauty, its employees, officers, directors, shareholders, agents, representatives, and its subsidiaries, parent companies, and other affiliated companies harmless from any and all damages, losses, claims, and/or liabilities arising out of his or her participation in the Sweepstakes or resulting from accepting or claiming any prize awarded hereunder. Mally Beauty reserves the right, in its sole discretion, to terminate, suspend, or otherwise cancel the Sweepstakes at any time for any reason. Each Winner will be required to complete an Affidavit of Eligibility and Liability/Publicity Release or his or her prize will be forfeited (except where prohibited by law). Participation in the Sweepstakes constitutes permission (except where prohibited by law) to use the Winner’s name, likeness, biographical information, photographs and any statements or remarks made about winning or participating in the Sweepstakes for advertising and promotional purposes (in any medium) without additional compensation. Participants acknowledge and agree that Mally Beauty may share any and all information collected through the Sweepstakes from time to time with their subsidiaries, parent companies, or other affiliated companies. Mally Beauty may verify that all Winners are qualified. If the Winner is disqualified or his or her prize is forfeited, Mally Beauty shall have the right, but not the obligation, to select an alternate Winner.
